The Contract
Wax Lyrical must receive payment of the whole of the price for the goods that you order before your order can be accepted. All payments shall be made in Sterling. Once payment has been received, Wax Lyrical will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Wax Lyrical's acceptance of your order brings into existence a legally binding Contract between you and Wax Lyrical. No variation of the Contract shall have effect unless agreed in writing by you and Wax Lyrical.
Price and Payment
The prices payable for the Goods that you order are as set out in the Website, and where appropriate are inclusive of VAT. You will be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Price and availability of goods is subject to change without notice.
Wax Lyrical accept Visa, Mastercard, Switch, Solo and Maestro credit/debit card payment.
An order confirmation will be sent by email on or before (but no later than) delivery of your good(s).
Credit Card Security
All credit card numbers are encrypted on your computer when the order is placed using 40 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any of the Website.
You are entitled to cancel any payment due to be made in respect of your order in the event that you discover that your card has been used fraudulently by any unauthorised person to buy goods under this Contract. Your card issuer will be liable to re-credit your debit, credit or payment card in respect of any sums already paid.
If you do discover that fraudulent use has been made of your card you should immediately notify both Wax Lyrical and your card company with full details.
Wax Lyrical reserve the right to cancel this Contract if we have insufficient stock to deliver the goods you have ordered. You will be notified by e-mail and we will re-credit to your account any sum deducted by us from your credit card as soon as possible, but in any event within 30 days of your order.
You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and Wax Lyrical will not be liable for their loss or destruction.
Liability
All good(s) are sold in accordance with Wax Lyrical's specification contained in the Website.
Wax Lyrical warrants that the good(s) will correspond with their specification in the website but does not make any other promises or warranties about the good(s).
Wax Lyrical shall be under no liability under the above warranty (or any other warranty, condition or guarantee) if the total price for the Good(s) has not been paid.
If the Goods Wax Lyrical deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Wax Lyrical shall have no liability to you unless you notify us within 7 working days of the delivery of the goods in question.
If you do not receive goods ordered by you within 30 days of the date on which you ordered them, Wax Lyrical shall have no liability to you unless you notify Wax Lyrical of the problem within 40
days of the date on which you ordered the goods. If you notify a problem to us under this condition, our only obligation will be, at your option:
consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to Wax Lyrical under this condition. Wax Lyrical shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the Goods in question.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of Wax Lyrical’s goods to you may be prohibited by certain national laws. Wax Lyrical make no representation and accept no liability in respect of the export or import of
the Goods you purchase.
Wax Lyrical shall accept no liability for the use of the good(s) by you other than in accordance with Wax Lyrical's instructions.
Notwithstanding the foregoing, nothing in these Conditions is intended to limit any rights you might have as a consumer neither under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
You will indemnify Wax Lyrical against all loss, damages, costs and expenses awarded against or incurred by Wax Lyrical in connection with any claim paid or agreed to be paid by Wax Lyrical as a consequence of the Consumer Protection Act 1987.
Wax Lyrical shall have no liability to you for any failure to deliver Goods you have ordered or any delay in doing so or for any damage or defect to Goods delivered that is caused by any event or circumstance beyond Wax Lyrical’s reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

days of the date on which you ordered the goods. If you notify a problem to us under this condition, our only obligation will be, at your option:
- to make good any shortage or non-delivery.
- to replace or repair any goods that are damaged or defective.
- to refund the amount paid by you for the goods in question in whatever way Wax Lyrical choose.
consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to Wax Lyrical under this condition. Wax Lyrical shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the Goods in question.

You will indemnify Wax Lyrical against all loss, damages, costs and expenses awarded against or incurred by Wax Lyrical in connection with any claim paid or agreed to be paid by Wax Lyrical as a consequence of the Consumer Protection Act 1987.
